No criminal charges to be filed against security officer who killed Liberty University student

A Lynchburg prosecutor says the guard acted in self-defense when shooting Joshua Hathaway. Investigators say Hathaway attacked the guard with a hammer. He was a freshman at Liberty University.


No criminal charges will be filed against the armed security officer who killed a Liberty University student at an off-campus dorm in November.

Lynchburg Deputy Commonwealth’s Attorney Jeffrey Bennett ruled that officer A.S. Mulberry acted in self-defense when he shot 19-year-old Joshua Hathaway on Nov. 19, 2013.

The investigation found that Hathaway attacked Mulberry with a mallet after telling him that his car was stolen. No drugs or alcohol were found in Hathaway's system.

Hathaway was from Texas and a freshman at Liberty University.
